Three routes, and the decision comes before registering

Freezing the benefit and getting it back if it does not work out

When you register as self-employed, unemployment benefit is suspended; if you stop before 60 months, it is resumed by applying within 15 days. It is the route with no exclusions and no payments.

Iván Soto is a photographer in Vigo. For eleven years he was on the staff of a studio covering weddings and events in the Rías Baixas, until the studio closed in September 2026. He has been granted 540 days of contributory unemployment benefit, at about 1,300 € a month. He wants to try going it alone with a different project: photo shoots of holiday accommodation for rental platforms. He does not need to invest, because he already has the equipment. Nor does he know whether there will be enough clients outside the season. And there is a detail that complicates things: his first client would be a company in the same group as the studio that dismissed him.

Iván is not trying to draw more. He is trying not to lose what he has if the project does not work.

Suspension is not applied for: it happens

Of the three routes for combining unemployment benefit and self-employment, this is the only one that does not require an application beforehand. Article 271.1.d) of the General Social Security Law provides that the right to the benefit is suspended while the holder carries out self-employed work "lasting less than sixty months" and is registered with the scheme for the self-employed. The period is twenty-four months if the activity is carried on while registered with an alternative professional mutual fund instead of the RETA (the special Social Security scheme for self-employed workers).

The essential point is in paragraph 2 of the same article: suspension interrupts the payments but "will not affect the period for which it is received". Iván's 540 days stay frozen; they are not used up while he invoices.

For Iván there is an extra advantage. Compatibility under article 33 of Law 20/2007 would be closed to him, because it excludes anyone who contracts with their last employer or with a company in its group. The lump sum for the economically dependent self-employed worker has a similar exclusion. Suspension has none of those restrictions: it applies to anyone who registers as self-employed.

What you have to do when you register

The fact that suspension is automatic does not mean there is nothing to do. Article 299.1.h) requires the beneficiary to ask to come off the benefit when a suspension situation arises, "at the moment those situations arise". If Iván registers and keeps drawing the benefit because he does not report it, those monthly payments will be undue and he will have to pay them back (art. 299.1.j).

The right sequence is simple:

  1. Registration with the RETA with the real start date of the activity.
  2. Notice to the SEPE (Servicio Público de Empleo Estatal, the Spanish state employment service) that you are coming off the benefit because you are starting self-employed activity, at that same moment.
  3. Keep the receipt: it will be the proof of the exact date on which the right was suspended.

Getting the benefit back: fifteen days and a registration

Article 271.3.b) governs resumption. It requires an application from the person concerned, proof that the reason for the suspension has ended and, for self-employed workers, registration as a jobseeker. Someone returning from self-employment does not have to prove a dismissal or a new legal situation of unemployment: it is enough to have stopped and to register again. The activity agreement also has to be reactivated, unless the employment service requires a new one to be signed.

The deadline is short again. The right to resume arises from the end of the reason for the suspension "provided it is applied for within the following fifteen days". If it is applied for later, the same article refers to article 268.2: the benefit is granted from the application and the days that have passed since the right would have arisen are lost.

Iván's figures in two scenarios

Suppose Iván registers on 1 November 2026 and, after two seasons, stops on 31 October 2028.

Scenario A: he applies to resume ten days later.

  1. Length of the activity: 24 months, well below sixty.
  2. Days of benefit frozen: 540.
  3. Application within the fifteen days: the benefit resumes from the day after he stops.
  4. What he gets back: the 540 days, about 18 months at 1,300 € = 23,400 €, approximately.

Scenario B: he finds out late and applies forty days later.

  1. Application out of time: the benefit is granted from the date of the application.
  2. Days lost: those between stopping and applying, about 40.
  3. Approximate cost: 40 × (1,300 / 30) = 1,733 €.
  4. What he gets back: about 500 days instead of 540.

The figures are illustrative: the SEPE does the calculation on the regulatory base and the exact days in its decision.

Five years, six years and fifteen days

Resumption depends on three different measures of time, and it is best not to confuse them:

The first clock is the best known: five years of activity. The second was added in 2024 and affects people who combine periods of activity with other reasons for suspension: if six years pass from when they stopped drawing the benefit without having resumed it, the right disappears. For someone following the usual pattern of registering, stopping and resuming, the first is the one that governs.

If you have combined benefit and activity for 270 days before stopping, the sixty months are counted from the date of registration, not from the end of the compatibility period (art. 33.3 of Law 20/2007).

A self-employed person who stops may also have another benefit

If Iván had paid enough contributions for cessation of activity during his time as self-employed, on closing he might be entitled to that benefit as well as to the suspended one. Article 271.3.b) requires him to choose between them, and the choice cannot be undone. It is worth comparing amounts and duration before signing the application; there is no answer that is right in every case.

Why it is the most cautious of the three

Suspension does not bring in a single euro during the activity. Iván draws nothing while he invoices, unlike what would happen with compatibility, and he receives no capital to invest, as he would with the lump sum. In return, it does not use up days of benefit, it has no exclusions for the last employer or for having used other routes, and it does not require any investment to be accounted for.

That is why it is the reasonable option in three situations: when the project is uncertain and what matters is being able to go back; when the other routes are closed, as in Iván's case; and when the deadline for the others has already passed.
