Three routes, and the decision comes before registering

I registered as self-employed without telling the SEPE: have I lost everything?

Registering without notice closes the lump sum, but compatibility stays open for 15 days and suspension keeps the right alive. Whatever was overpaid is repaid.

Nuria Campos, 33, is a hairdresser in Murcia. Until March she worked at a salon in the centre that closed when the owner retired, and since then she has been drawing a contributory unemployment benefit of about 1,080 € a month, with 380 days left. At the end of June she rented a chair in another salon in the Santa María de Gracia neighbourhood and, on the owner's advice, registered as an autónoma (the Spanish term for a self-employed person) with effect from 1 July 2026. She said nothing to the SEPE (Servicio Público de Empleo Estatal, the Spanish state employment service): she thought Social Security would tell it. Since then she has carried on drawing the benefit: the full July and August payments have arrived. A colleague has told her she has lost her benefit for good and that she could be fined as well.

Neither is automatic. What she has lost depends on how many days have passed since she registered, and what she can recover depends on what she does now.

Which routes are still open, depending on the time that has passed

Registering with the RETA (the special Social Security scheme for self-employed workers) does not in itself tell the SEPE that the beneficiary wants one route or another. Each route has its own moment, and registration is the reference point for all of them:

The lump sum falls on the first day. Rule 3 of article 34.1 of Law 20/2007 requires an application "dated before" the start of the activity, and treats as the start the date shown on the registration application. The SEPE's own website warns that it will refuse the lump sum if, when you apply, you are already registered as self-employed. For Nuria that door has been closed since 1 July.

Compatibility holds out for fifteen more days. Article 33.1 of the same law allows it to be applied for within the fifteen days following the start of the activity, with effect from that start. Once that period has passed, the worker "may not opt" for it. Nuria is too late for this one as well, because the period ended in mid-July.

Suspension, on the other hand, is not lost. It is the consequence the law attaches to registration (art. 271.1.d of the General Social Security Law), and it keeps the days not drawn. Nuria has not lost her benefit: she has it frozen.

What she does have to do now

Nuria's real problem is not the route but the fact that she is still drawing the benefit. Article 299.1.h) requires the beneficiary to ask to come off the benefit at the moment the suspension arises, and letter j) to repay whatever has been received unduly. The sooner she puts it right, the less she will have to pay back and the better her position will be if the SEPE opens proceedings.

The sequence for Nuria:

  1. Tell the SEPE she is coming off the benefit because she has started self-employed activity, with effect from 1 July, and keep the receipt.
  2. Work out what was overpaid. The suspension runs from 1 July, so July and August are undue: 60 days × (1,080 / 30) = 2,160 €, approximately. If the September payment arrives before the SEPE records that she has come off the benefit, it will have to be added.
  3. Pay it back by the procedure the SEPE indicates, or wait for its claim if she prefers the body itself to fix the amount.
  4. Keep the registration paperwork: it will be the basis for applying to resume the benefit on the day she stops.

With those steps, the days she has not used up remain available. It is worth asking the SEPE, when it closes the overpayment, to confirm in writing the balance of days outstanding: that is the figure that will be resumed. The details of resumption are in freezing the benefit and getting it back.

Drawing the benefit without reporting it can lead to a penalty

Article 271.1.a) of the General Social Security Law already provides for suspension as a result of penalties imposed for minor and serious infringements under the rules on social-order infringements and penalties. Keeping the benefit while registered without reporting it may fall within one of them. Putting it right on your own initiative does not remove the risk, but it reduces it. We cannot predict whether the SEPE will open proceedings or with what result.

When the registration date is wrong

Sometimes the registration shows a date that does not match reality: whoever handled it got ahead of the real date, or a start date was entered that was not the date of the first job. In that case the problem lies not with the SEPE but with the Social Security General Treasury, and the correction is requested there, with evidence of when the activity actually began: the chair rental agreement, the first invoice or the licence.

It is worth being honest about how far this goes. Correcting a wrong registration is legitimate; delaying a correct registration to reopen a deadline is not, and the authorities will cross-check the date against the invoices and payments. If Nuria charged for her first service on 2 July, the registration on the 1st is correct and there is nothing to correct.

If there is already a refusal

Let us take another case. Tomás, in Cartagena, registered on 1 August and filed his compatibility application on 12 August, within the deadline, but the SEPE has refused it, claiming he did not apply in time. Or that his last employer belongs to the same group as his first client, when it does not. Unemployment benefit decisions are not challenged before the administrative courts but before the social (employment) courts, and the path has three steps:

  1. Prior claim to the body that issued the decision, within thirty days of notification (art. 71.2 of the Law governing the social jurisdiction).
  2. The SEPE's reply, which must come within forty-five days; if it does not, the claim is deemed refused (art. 71.5).
  3. Court claim before the Social Court within the thirty days following the refusal, whether express or by silence (art. 71.6).

The prior claim only succeeds if there is a solid argument: a receipt showing filing in time, a factual error in the decision or an exclusion wrongly applied. If the application really was filed out of time, article 33.1 leaves no room, and appealing only prolongs the uncertainty.

What Nuria has left from here on

Nuria will not get the lump sum for this benefit again while she remains registered. Nor compatibility. What she keeps are her days of benefit, which she can resume if she closes the activity before sixty months and applies within the fifteen days following closure.
